There is an ever increasing focus on the role that agricultural land can play in climate change and the potential opportunities that will exist to generate new income streams.
There is an ever increasing focus on the role that agricultural land can play in climate change
Most existing agricultural tenancies will not properly capture these opportunities so it is important for landlords and tenants to discuss and agree who might ultimately benefit from any new arrangements relating to biodiversity gain, nutrient neutrality, rewilding, carbon offsetting, etc.
It is likely that these agreements will require the land to be managed in a different way which may impact the tenants use of the land and limit agricultural productivity.
These schemes may affect the use and condition of the land in the long-term and may come with onerous restrictive covenants that could affect the value of the landlord’s interest.
It’s important that agricultural tenancy documents are drafted in a balanced and fair manner to ensure that neither party has a free reign and if opportunities exist in the future, then both the landlord and tenant can benefit and the interests of both parties protected.
Whether you have an existing tenancy or are about to renew your tenancy, it is important to keep tenancy documents under review to ensure that they are fit for purpose.
